Health
Insurance Portability and Accountability Act of 1996 (HIPAA)
Public Law 104-191
HIPAA Law amends the Internal Revenue Code of 1986 to improve
portability and continuity of health insurance coverage in the group and
individual markets, to combat waste, fraud and abuse in health insurance
and health care delivery, to promote the use of medical savings accounts,
to improve access to long-term care services and coverage, to simplify
the administration of health insurance, administrative simplification,
and for other purposes.

Title II, Subtitle F, Administrative Simplification
Administrative Simplification provisions are being implemented by the
State of Ohio agencies impacted by its provisions. Administrative Simplification
requires that health plans, health care clearinghouses use certain standard
transaction formats and code sets for the electronic transmission of health
information. Health care providers that transmit any health information
in electronic form in connection with a transaction covered in the rules
are also required to use the standard transactions and codes sets for
the electronic transmission of health information. In addition, it establishes
standards for the protection and security of individually identifiable
health information, and provides penalties for its wrongful disclosure.
The purpose of this Subtitle is to enhance health care insurance and delivery
systems by making them more efficient, simpler, and less costly.
Administrative
Simplification Compliance Act (ASCA)
Public Law 107-105
ASCA allows the implementation date of the Transaction and
Code Sets Rule to be extended from October 16, 2002 to October 16, 2003.
ASCA requires that covered entities that wish to request an extension
until October 16, 2003, submit a compliance plan to the Secretary of the
federal DHHS by October 16, 2002. The plan must include a budget, schedule,
work plan, and implementation strategy for achieving compliance. The Act's
provisions do not affect the implementation date of October 16, 2003 for
small health plans or the Privacy Rule's compliance date of April 14,
2003. (Small health plans are required to implement the Privacy Rule by
April 14, 2004.)
